Law360 Canada ( January 21, 2025, 9:23 AM EST) -- Appeal by Givogue from dismissal by Federal Court of his application for judicial review of complaint he submitted to Canadian Human Rights Commission (Commission) against his employer, Fisheries and Oceans Canada. Givogue asserted that Fisheries discriminated against him in employment on the grounds of genetic characteristics and “partial/perceived disability” by denying him workplace accommodations when he objected to disclosing his COVID-19 vaccination status. The Commission found the complaint frivolous, as it failed to establish a link between the employer's conduct and a prohibited ground of discrimination under the Canadian Human Rights Act (Act). The Federal Court dismissed Givogue's application for judicial review, holding that the Commission reasonably concluded the complaint could not succeed and was frivolous, as Givogue failed to establish that the vaccination status disclosure requirement was genetic discrimination.
