Law360 Canada ( January 17, 2025, 8:55 AM EST) -- Appeal by Karl of chambers judge’s decision which granted summary judgment in favour of plaintiff, Dion Resources Inc. (Dion), and against defendants, Karl and 102001392 Saskatchewan Ltd. (Echo Refinery). The chambers judge found that the parties entered into a settlement agreement at mediation and that Dion was entitled to judgment in accordance with the terms of that agreement. Ultimately, the chambers judge found that there was no genuine issue requiring a trial and ordered: summary judgment as against Karl and Echo Refinery for $1,650,000; all the claims of Dion against Echo Refinery and Karl be released; that other separate legal proceedings be discontinued; and that Echo Refinery's contempt in one of the discontinued actions was purged. In addition to granting judgment in favour of Dion, the chambers judge dismissed an application by Karl and Echo Refinery seeking a declaration that no binding settlement had been reached at mediation. Karl appealed the chambers decision and contended there were genuine issues requiring a trial. In his factum, Karl also sought a dismissal of the claim against him, but that relief had since been abandoned....
