DISCHARGE OF BANKRUPT - Conditional discharge - Upon payment of fine - Upon total or partial repayment

Law360 Canada ( October 11, 2024, 1:56 PM EDT) -- Application by Trustee in Bankruptcy for a conditional discharge of the bankrupt Wojciechowski ("the bankrupt") upon payment of $2,051, payable in monthly installments. Creglia objected to the discharge of a debt owed to her company, Mid-Can Roofing and Sheet Metal Ltd., ("Mid-Can") arguing it was incurred through fraudulent misrepresentation. Creglia testified that Wojciechowski hired her company for roof repairs, claiming she would pay either through a credit union loan or with her father's help. After completing the work, Wojciechowski avoided paying, providing various excuses involving issues with the credit union loan. Creglia sued Wojciechowski in Small Claims Court and obtained an uncontested judgment. However, Wojciechowski still did not pay and eventually filed for bankruptcy. Wojciechowski claimed the credit union initially assured her that a loan would not be an issue, but the funding was later declined. She stated that her father was unable to help her, she had been in and out of work, and denied any intention to defraud Creglia....
