In a sleeper ruling that may affect some driving bans imposed for criminal negligence and possibly manslaughter since Bill C-46 came into force in 2018, the Supreme Court of Canada has ruled 5-4 that sentencing judges cannot impose driving prohibitions under Criminal Code s. 320.24(4) for criminal negligence causing death/bodily harm.
