Law360 Canada ( November 24, 2022, 1:03 PM EST) -- Appeal by Jaffer from a decision of the Ontario Court of Appeal that affirmed the dismissal of his application for a stay of proceedings regarding his convictions for luring and a s. 286.1(2) offence. Jaffer, who had Asperger’s Syndrome, was one of 104 people arrested during an online investigation, “Project Raphael”, conducted by the York Regional Police that targeted underage sex work. After Jaffer responded to a police ad in the escort subdirectory of Backpage.com, an undercover officer arranged a transaction with Jaffer, revealed she was 15-years-old, and invited him to a hotel room. When Jaffer arrived at the hotel room, he was arrested. Jaffer was convicted at trial and unsuccessfully applied for a stay of proceedings based on entrapment. The application judge found Project Raphael was a bona fide inquiry. The Court of Appeal dismissed Jaffer’s appeal....
