Human rights tribunal rejects Canada’s largest class action settlement as underinclusive

By Cristin Schmitz ( October 26, 2022, 4:46 PM EDT) -- Reminding Ottawa and the Assembly of First Nations (AFN) that the parties to Canada’s largest class action settlement agreement cannot “contract out” of previously made human rights compensation orders, the Canadian Human Rights Tribunal (CHRT) has declined to endorse the $20 billion in proposed federal compensation to individual First Nations children and family caregivers for discriminatory federal underfunding of child welfare services on reserve because the deal fails to compensate some of those the CHRT had ordered to be compensated....
