CIVIL PROCEDURE - Appeals - Leave to appeal

Law360 Canada ( September 19, 2022, 9:14 AM EDT) -- Applications by the successful plaintiffs for declarations that the notices of appeal filed by a trustee in bankruptcy were a nullity as leave to appeal was required. Motion by the law firm that represented the Trustee for an order adding it as a respondent under Rule2(2) as a person who could be affected by the orders sought. The appeals were filed in three related bankruptcy proceedings and two related civil actions from orders requiring the Trustee and its counsel to repay substantial amounts of professional fees paid to them in accordance with previous court orders. The Trustee purported to file the notices also on behalf of its counsel. The law firm was not a party....
