Law360 Canada ( June 13, 2022, 9:39 AM EDT) -- Application for summary trial by the District of Saanich (the “Municipality”) to dismiss Forbes’ claims. The vehicle driven by Forbes collided with the bicycle operated by Ladouceur, a user of the Galloping Goose Regional Trail who was crossing the road. She was knocked off her bicycle and suffered injuries. Ladouceur claimed damages against Forbes and Canada Post Corporation without advancing a claim against the Municipality or the Capital Regional District. Forbes brought an application for leave to file a third-party notice against the Capital Regional District and the District of Saanich. The third-party notice alleged negligent design of the intersection, and inadequate signage on the Trail. Forbes claimed contribution and indemnity. The Municipality invoked the Local Government Act which required notice of the time, place, and manner in which the damage was sustained to be delivered to the municipality within two months from the date on which the damage was sustained....
