SENTENCING - Offences tending to corrupt morals - Child pornography

Law360 Canada ( February 11, 2022, 6:40 AM EST) -- Appeal by Crown to increase sentence of McCrimmon from 20 months' imprisonment and two years' probation to three years jail term and 20 years’ prohibition for child pornography. The Crown argued that the sentence reflected material errors in principle. It contended the judge did not adequately consider the size and gravity of McCrimmon’s child pornography collection and the fact that he uploaded an image to the Internet. Moreover, the Crown argued that the judge misapprehended the fact, failing to appreciate that McCrimmon was viewing child pornography for close to two decades, rather than one, and that some of the children in the images and videos were as young as six months, rather than two years old as stated by the judge.
